SUMMARY:

This research aims to analyze the history of Black people’s presence in Brazil’s higher courts. It seeks to racialize the institutional interpretative theory of the legal phenomenon as well as the theoretical discussion on access to justice. The narrative is guided by two mythological figures, Hercules and Orpheus. As primary X 2 sources, the study utilizes certain legal actions available in the digital archive “Arquivo Joaquim Nabuco” under the custody of the Supreme Federal Court. Among the selected cases are one from the Tribunal da Relação of Rio de Janeiro, one from the Casa da Suplicação, and two from the Supreme Court of Justice. All selected actions are marked by racial conflicts and mostly involve freedom suits. The timeframe extends from the Colonial Period, with the recording of the first action in the Archive, to the present day. The analysis of the archive documents will be conducted using the method of social microhistory. In a second phase, the research will explore the possible theoretical intersections between racial debate and critical discussions on representation, justice, participation, and institutions, with a special focus on the Supreme Federal Court. The study will conclude by highlighting the limitations and challenges in the communication between the theory of access to justice and the Black question.
