This doctoral dissertation aims to go beyond the problem of “fake news” to focus on more specific and objective aspects, such as the effects that digital technologies have as a complex socio-technical system on freedom of expression and the processes of identity formation at the individual and collective level. The main theoretical framework of reference is the theory of biopolitics developed by Michel Foucault. As methodological approach was proposed a case study of a Brazilian jurisprudential decision. In this way, this is defined as a predominantly empirical, qualitative, exploratory and inductive study
