SUMMARY:

The research will seek to associate elements of neoliberal rationality and austerity policies to the erosion of the Social State of Law and, consequently, to the educational dismantling in Brazil, which occurred mainly after the
implementation of Constitutional Amendment 95/2016, which imposed the ceiling of public spending in the country. To carry out such analysis with the necessary acuity, the study will be limited to the period from 2016 to 2022, which involves the interstice of deepening of neoliberal policies in national territory, and the educational setbacks that occurred in the Federal Institutions of Higher Education - IFES, strongly affected during the period examined. Based on a solid theoretical foundation, we will initially delimit the austerity context in which the Constitutional Amendment of the Public Spending Ceiling was implemented, and then analyze its actors, mobilizers, and normative impacts on social rights in Brazil. Next, we will examine the budgetary consequences of the amendment on public higher education in the country, in order to demonstrate the setbacks that occurred in this area and the paths that led to the precariousness of Universities and Federal Institutes of Higher Education throughout the period under analysis. Finally, a case study will be conducted at the University of Brasília - UnB, which will bring subsidies, along with the analysis at the national level, to answer the research problem, which is: Which sectors of Brazilian Higher Public Education were most strongly impacted by the Constitutional Amendment of the Public Spending Ceiling during the period from 2016 to 2022? Thus, through a quali-quantitative methodology, supported by bibliographic, documentary and discourse analysis, as well as the examination of numerical data regarding the budget of IFES and, specifically, of UnB - the institution where the empirical study will be conducted - the research will seek to prove or disprove the hypothesis that EC 95/2016 does not reach the entire Brazilian population in an equal way, and in higher public education, similarly, the sectors of Student Assistance  - which benefit students with socioeconomic vulnerabilities, indigenous populations and afrodescendants - have been the hardest hit, a fact that makes it difficult for students in these conditions to enter and remain in public, free and quality education, and increases the alarming structural exclusion already existing on Brazilian soil.
