SUMMARY:

Law usually claims for itself some predicates, among which, rational and scientific. These predications, however, seem to be, fundamentally, attached to the theory of Law, being mitigated, perhaps eclipsed, in legal practice. Investigating possible causes of the theory of Law being discrepant from its practice, implies, in effect, thinking about the knowledge that one has of Law in Law, which was done, in this thesis, through a qualitative research, essentially, descriptive, bibliographical and exploratory. Initially, properties and definitions of Law were analyzed from brazilian authored books, presumably more used in disciplines that have the definition of Law as a primary object of research. Next, the philosophies of Plato and Aristotle were examined, considering the influence of these thinkers on the way that Law conceives knowledge, for example, the role of reason in relation to errors perpetrated by the body, as well as the distinction of what belongs to the field of theory and what concerns the scope of practice. The philosophy of Benedictus de Spinoza, then, is introduced, being presented fundamental notions of his ontology and epistemology, with the aim of explaining significant diferences regarding the common philosophical foundations in Law, briefly addressed through Plato and Aristotle. Having as a hypothesis the understanding that the practice of Law differs from its theory because the Law is not seen as it really is, but as it shall be, this work ends with the intention of demonstrating, in a certain way, the possibility of amending the Law, combining theory with practice, through Spinoza’s philosophy, which allows knowing the affections to extend power.
