SUMMARY:

This thesis investigates how victims of sexual violence in the context of conflicts and humanitarian crises can be protected and compensated by International Law (IL). The study seeks to answer the following guiding question: How can the reparation systems of the International Criminal Court (ICC) and the Inter-American Court of Human Rights (IACHR) contribute to victim-centered reparation for sexual violations in UN peacekeeping missions? To this end, it begins with an analysis of the victim reparation systems of the ICC and the IACHR and how these systems, through a jurisprudential examination of selected cases, treat victims of sexual violations. Following this, it examines how the UN assists victims of sexual exploitation and abuse (SEA) in peacekeeping operations and how its Trust Fund functions. The study continues with a comparative analysis between the systems and how these systems can contribute to the reparation of victims of sexual violations in humanitarian missions. The hypothesis of this thesis is that reparations for victims of sexual and gender-based violence under International Law in this conflict scenario are insufficient and require improvement through a truly victimcentered approach. To this end, it adopts a qualitative and exploratory methodology, which includes extensive bibliographic analysis (articles, books, theses and dissertations), documentary analysis – resolutions, reports and official documents from the UN, NGO reports and media reports – and jurisprudence from the IACHR and the ICC on sexual violence in armed conflicts. Focusing on a victim-centered approach (Cançado Trindade, 2007) and the complexity of sexual exploitation and abuse in peacekeeping missions (Westendorf; Dolan-Evans 2024), it seeks to present possibilities for improving reparation measures for victims of sexual violence (Daukaus, 2024) in armed conflicts and other crisis situations.
