The research contextualizes the historical and conceptual evolution of AI and the centrality of human decision as a fundamental guarantee. The theoretical framework delves into the philosophy of technology, exploring Don Ihde’s phenomenology of technological mediation and Andrew Feenberg’s critical theory, with the aim of proposing pathways for the protection of this right and the construction of a decisively human society
