SUMMARY:
Since its beginnings, aviation has been seen as a topic of international interest, being one of the areas of law that most expresses the interrelationship between Public and Private. If there is convergence between Public and Private Law at the international level, there is, at the Brazilian level, a profound divergence in the application of the Montreal Convention, as well as of Themes 210 and 1240 of the STF to judicial cases, in which, also, there is an application of moral damages in re ipsa, which has generated an excessive use of the Courts, a legal uncertainty, an inconsistency and loss of coherence and unity of the legal system of Aeronautical Law. However, in a globalized world, the passenger is no longer national or international, he is global. In Brazil, there seems to be a challenge in the applicability of international civil liability rules in air transport. Let’s research if this same challenge occurs in other countries of the Americas, to finally check what would be the ideal alternative for the global passenger.
