THE CONSTITUTIONALITY OF THE REGIONAL BONUS POLICY FOR ADMISSION TO PUBLIC UNIVERSITIES: A REFLECTION ON ACCESS TO MEDICINE COURSES IN PUBLIC UNIVERSITIES IN THE NORTHERN REGION OF BRAZIL

The research seeks to discuss the constitutionality of the regional bonus policy for entry into higher education, applied to the Enem grades of candidates who completed high school in the locality of public universities, especially for vacancies in medical courses in the North of Brazil.
This is because with the advent of the Unified Selection System – Sisu, which is an electronic system that brings together vacancies offered by public higher education institutions throughout Brazil for the selection of candidates for undergraduate courses at participating institutions, with based on the score of the National High School Exam – Enem, through competition, established by the Ministry of Education in 2010, there was the universalization of the offer of vacancies in Public Higher Education Institutions, increasing the movement of candidates between the federative units , considering that it is not necessary to travel to compete for vacancies in other states.
Faced with the new reality, the most competitive undergraduate courses, such as the medical course, have become highly coveted, in universities in peripheral regions, by candidates from all states, so that the vacancies previously offered, within the scope of entrance exams in the states where these universities are located, they began to be widely contested by students from all over the country, depending on the performance they obtained in their Enem grades.
In this context, in some locations, there was a phenomenon in which medical course vacancies were occupied by students, mostly from other states, frustrating the expectations of students from less developed regions in occupying these vacancies, largely due to lower performance in grades. Enem, an exam applied nationally, the basis for admission through Sisu, compared to students from regions with higher levels of educational levels.
This situation aggravates another existing problem, which is the difficulty in retaining medical professionals in these peripheral regions of Brazil, particularly affecting the supply of public health services, considering the low level of participation of newly trained professionals from other states to remain in the region. in which he graduated.
Faced with exclusion in the occupation of vacancies, public higher education institutions located in these locations implemented affirmative action policies that apply a bonus to Enem grades for candidates who have proven to have studied all of secondary education in the region where the institution itself is located. teaching, in order to protect the right to education of these candidates who do not have the best conditions to compete.
