FUNDAMENTAL RIGHT TO DIFFERENCE: the land policy for the State of Piauí in the processes of regularizing the territories of quilombola communities.

This thesis proposal aims to analyze the recognition of the fundamental right to difference in the land policy of the State of Piauí in the processes of regularization of the territories of quilombola communities. To this end, we start with the following question: how is the fundamental right to difference recognized in this land policy of the State of Piauí? Thus, to achieve this analysis, some objectives will be pursued, namely: identifying quilombola communities in Piauí and their struggle for land regularization; observe quilombola territoriality as a predecessor to property rights; discuss the fundamental right to difference as a guarantee of the right to exist of quilombola communities; and finally, analyze the land policy of the State of Piauí in the execution of the processes of quilombola communities. To achieve these objectives, the methodological path adopted will be qualitative, through bibliographical and documentary research (legislation and administrative processes) and empirical research with semi-structured interviews with actors involved in the land regularization of quilombola communities. Finally, it is concluded that it is necessary to face the decades-old obstacles to the real realization of the right to quilombola land, guaranteed in the 1988 Federal Constitution.
