SUMMARY:

Several ongoing projects using artificial intelligence (AI) in the Brazilian Judiciary present themselves as a panacea for solving the current budgetary crisis and ensuring the effectiveness and consistency of the judicial service. However, there has been little debate on how the use of AI in judicial systems may potentially affect their legitimacy. Nor have the ethical and legal principles that should guide the application of AI in judicial settings to preserve its legitimacy. To fill this gap, this research aims to address the following questions: Does the use of AI in judicial systems have an impact on their legitimacy? Does this impact depend on factors related to the perceived justice of judicial procedure? Are the most influential procedural justice factors aligned with the most significant ethical AI principles that have been putting in place by Unesco, the Brazilian National Council of Justice, and other notable organizations. A variety of methods will be deployed to answer them. The present investigation will begin with a more in-depth and systematic study of artificial intelligence, its foundations, modalities, applications, recent developments, and its prominent ethical principles. Secondly, I will analyze how AI could be used to better the judicial work, state-of-the-art practical projects under development, in Brazil, Canada, United States and Europe. Next, a literature review will be conducted on the legitimacy of the Judiciary, adopting as a reference the concept of procedural justice and the factors that influence it. In a fourth phase, based on these initial elements, I propose an experiment to examine whether the use of AI by the Judiciary (independent variable x) correlates with the perceived fairness of its rulings (dependent variable y). The factors that influence the perceived fairness or procedural justice of rulings will be used as a proxy indicator to the legitimacy of the Judiciary. Finally, I will examine the results regarding the most influential factors on the procedural justice of AI use in judicial systems, and hopefully will assess it they are aligned with the prevalent AI ethical principles that tend to have an impact on ongoing discussions regarding the development of comprehensive regulatory framework pertaining to AI.
