Right to information. Science. Health. Risks. New technologies in assisted reproduction.
The paper aims to study the framing of information on the risks of new technologies in assisted reproduction under the framework of article 5 of the Brazilian Access to Information Law. In that context, the legal interpretations that guide the judicial decisions of the Court of Justice of the State of Rio de Janeiro (TJRJ), the Court of Justice of the State of Rio Grande do Sul (TJRS), and the Court of Justice of the State of São Paulo (TJSP) gain relevance to understanding the delineations of the duty to provide information in the doctor-patient relationship as well as the judges’ limits of interpretation about the meaning of technical concepts related to reproductive technologies. Moreover, it is relevant to understand the forms of participation and perception of social actors belonging to interest groups involved in public policies on access to health technology, especially in the context of public hearings’ major debates. In addition, it is necessary to investigate how the judiciary accommodates those debates when it comes to assisted reproduction. The lessons learned are applied to forecast scenarios for new reproductive technologies with the theoretical support of the “technologies of humility” conceived by Sheila Jasanoff.
