SUMMARY:

This research aims to outline, based on Michel Rosenfeld's theory of constitutional identity, the constitutional identity of workers who are active as digital affiliated salesperson in retail companies in Brazil. The approach, permeated by the desire to reflect on the impact of the new neoliberal rationality and its discourses on social bonds and the (de)construction of the subject of socio-labor rights, considers the ILO's parameters for decent work and the Federal Constitution's parameters for dignified work, from which it seeks to answer the following question: what kind of constitutional subject emerges from the perception of digital affiliated salesperson about work on digital platforms and the human and fundamental labor rights inherent to it? The theoretical-practical research, which is bibliographic and multidisciplinary in nature, adopts a quantitative-qualitative approach and the phenomenological method, insofar as it focuses on one of the main social actors responsible for the process of constructing constitutional identity in the world of work: the worker subject.
