SUMMARY:

The central question of the thesis is to answer the following research problem: How should the value of invention and human creation be weighed against innovation and creation derived from AI? Does the advent of AI require changes to existing intellectual property structures? The identification of the problem is characterized by the perception that the profound transformations brought about by AI impose the need for new perspectives for understanding the very concept of intellectual property, with the consequent development of new analysis tools, so that the challenges imposed by this new reality can be satisfactorily addressed, mainly due to the fact that there is a very unequal technological capacity among countries in the field of AI, especially in Brazil.

The fact is that the patent system has this inclusive and transformative character, that is, technological evolution is undeniable, generating challenges for a system that is constantly tested in its capacity to deal with these new technologies without losing its essence. This was the case (and continues to be the case) with new technologies such as AI and others that are emerging and will continue to emerge, putting the patent system and questions about software copyright to the test regarding their inclusive capacity without losing their essence. But what is the essence of the patent system? What are its reasons for existing and what are its objectives? Furthermore, how different are the challenges posed by artificial intelligence applied to technical solutions when compared to the historical challenges that the patent system has faced and still faces?

Despite recognizing the cross-border nature of the matter, the research would seek to highlight the particularities inherent to national conditions, as a country still developing, to address the treatment deemed most appropriate to the topic and our social reality, considering that there is no adequate legislative format on IP and AI, especially when we address patents and copyright, in addition to a legal approach appropriate to the peculiarities that AI presents to us.
