The democratic recession and abusive constitutionalism in Brazil

The paper seeks to understand the phenomenon of democratic recession, which has been identified by many legal scholars and political scientists globally. It concerns a new form of coup against democracy, carried out through institutional mechanisms. Now would-be autocrats rise to power legitimately through electoral means, dominate the very institutions that sustain liberal democracy, and degrade them with the aim of perpetuating power. Among these forms is the use of constitutional amendments, which, when employed with the purpose of making the state significantly less democratic, gives rise to what is called abusive constitutionalism. The paper thus aims, first, to understand this phenomenon and, second, to determine whether it has affected Brazil and, if so, to what extent, specifically during the four years of the Bolsonaro administration.
