This research provides a comparative analysis of Preliminary Technical Studies (ETPs) in Brazilian public procurement, as required by Law No. 14,133/2021, in relation to equivalent practices adopted in European Union member states, particularly those guided by Directive 2014/24/EU. The study examines three central dimensions — cost estimation, risk analysis, and sustainability criteria — and discusses the emerging role of artificial intelligence as a supporting tool in the development and improvement of these instruments. It further proposes a critical reflection on how ETPs can evolve from a merely formal requirement into a strategic planning instrument capable of promoting efficiency, transparency, innovation, and sustainability in public procurement. By contrasting the Brazilian and European experiences, the research identifies the potential for technological integration and normative convergence aimed at strengthening public governance and improving the quality of public spending. The relevance of this study lies in its contribution to the debate on the modernization of public procurement, highlighting how technical improvement and intelligent data use can reduce information asymmetries, prevent risks, and align Brazil with international standards of sustainable and digitally oriented public management.
